FMCSA Announces More Details About Broker Transparency Rulemaking

FMCSA’s proposal to improve broker transparency in the trucking industry could be released sometime this summer. According to the U.S. Department of Transportation’s Spring 2023 Unified Regulatory Agenda, FMCSA is scheduled to publish a notice of proposed rulemaking regarding transparency in property carrier broker transactions. The notice indicates that FMCSA will amend broker rules in response to a petition from OOIDA.

In 2020, OOIDA asked the agency for more transparency in transactions with brokers. The petition requested that FMCSA require property brokers to provide an electronic copy of each transaction record automatically within 48 hours after the contractual service has been completed and prohibit explicitly brokers from including any provision in their contracts that requires a motor carrier to waive its rights to access the transaction records.
